Terms of Use

These terms are an agreement between you and Mister Business Enterprises ("we") for using Pingsterz. By creating an account you accept them.

1. Who can use Pingsterz

You must be 18 or older. One person, one account. Keep your sign-in to yourself; you are responsible for what happens in your account.

2. What Pingsterz is

Pingsterz shows where people are right now. You drop a ping at the place you are, with an optional photo and caption. A ping is public for up to 60 minutes (two hours with Pingsterz+, section 10) and then disappears. See the Privacy Policy for what that means for your data.

3. Community rules

There is no tolerance for objectionable content or abusive behaviour. You agree not to:

• place a ping anywhere other than where you actually are, or fake your location;
• post nudity, sexual content, violence, hate, harassment, threats or anything illegal, in photos, captions or usernames;
• post a photo that singles out someone who would not want to be shown, or share anyone's private information;
• use Pingsterz to stalk, follow or intimidate anyone;
• impersonate someone else, or run automated or fake accounts;
• interfere with the service or try to get at other people's data.

Report anything that breaks these rules with Report, on the ping or on the person's profile. We review reports within 24 hours and remove content and accounts that break the rules. You can block anyone at any time.

4. Your content

You keep ownership of the photos and captions you post. You give us permission to store them, to have them checked automatically, to show them to other people using Pingsterz for as long as your ping is live, and to keep what was reported for as long as this section says.

Before others see a photo, it is checked automatically together with its caption. The check is done with the AI service of TypeSafe, an AI company, which receives the photo and the caption for that purpose. The app asks for your permission before your first photo. Until the check has approved the photo, nobody but you sees that ping. A photo that the check flags, or that it cannot check, is not approved, and nobody else sees its ping. Captions and usernames are also checked against a list of words on our own servers, and one that contains a word on the list is refused.

If someone reports your ping, the report keeps its caption and your username for up to 12 months, also if you delete your account in that time. Its photo is moved, when the ping ends, to storage that only we can read, and deleted 14 days later; you cannot delete it yourself. We use these to review the report and to act on people who break the rules again. A report on you as a person keeps your username in the same way. We do nothing else with your content, unless the law requires it. You confirm that you have the right to post what you post.

5. Moderation

Photos are checked automatically before others see them, captions and usernames are screened, and people can report pings and other people. A ping that several people report is hidden from everyone. We may remove content or suspend or close an account that breaks these terms, without notice where the breach is serious.

6. Be careful out there

Pingsterz shows activity that people report themselves. It can be wrong, late or faked. Do not rely on it for your safety or for decisions that matter. Whether to go somewhere, and whether to tell the world you are there, is your decision.

7. Ending your account

You can delete your account in Settings → Delete account at any time. If you have not chosen a username yet, the same button is on the screen that asks for one. The Privacy Policy says what is removed at once and what is kept for a time: reports, and a photo that was reported. We may close accounts that break these terms.

8. The service is provided as it is

We work to keep Pingsterz running but do not promise that it will always be available or free of errors. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the greater of what you paid us for Pingsterz in the past twelve months and US $50. Nothing here limits liability that cannot be limited by law.

9. Changes

We may change Pingsterz and these terms. The date at the top of this page says when they last changed. If a change matters, we will publish the new terms on this page before they apply. If you keep using Pingsterz after that, you accept the change.

10. Pingsterz+

Pingsterz+ is an optional subscription. While you have it, your pings last two hours instead of one, Friends nearby alerts you about friends up to about 15 km away instead of 5 km, you can pick a colour for your pings that everyone sees on the map, and your profile shows a Plus badge. What it includes can change; we will not take a perk away during a period you have already paid for.

• Price and period. The app shows the price of each option, monthly or yearly, in your currency before you buy. Payment is charged to your Apple Account when you confirm the purchase.
• Renewal. The subscription renews automatically at the end of each period, at the same price, unless you cancel it at least 24 hours before the period ends. Your Apple Account is charged for the renewal within the 24 hours before the period ends. If the price changes, Apple tells you first and, where the rules require it, asks you to agree.
• Cancelling. Manage or cancel it in your Apple Account settings, or in the app under Settings → Pingsterz+ → Manage subscription. You keep Pingsterz+ until the end of the period you paid for.
• Refunds are handled by Apple, under Apple's terms, at reportaproblem.apple.com. We cannot refund App Store purchases ourselves.
• Your account. Pingsterz+ belongs to the Pingsterz account you bought it on. Another Pingsterz account signed in with the same Apple Account does not get it. Deleting your Pingsterz account does not cancel the subscription: Apple goes on charging until you cancel it in your Apple Account settings.
• If we close your account for breaking these terms, Pingsterz+ ends with it; ask Apple about a refund for the rest of the period.

11. If you got Pingsterz from the App Store

• These terms are between you and us, not Apple. Apple is not responsible for Pingsterz or its content.
• Your licence to use Pingsterz is limited to Apple devices you own or control, as the App Store's usage rules allow.
• Apple has no obligation to provide maintenance or support for Pingsterz.
• If Pingsterz fails to meet a warranty that applies, you may tell Apple, and Apple will refund what you paid for it, if anything. Apple has no other warranty obligation.
• We, not Apple, are responsible for claims about Pingsterz, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
• You confirm that you are not in a country under a United States Government embargo and are not on a United States Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
